PRODUCT LIABILITY / DEFECTIVE PRODUCTS

We obtained a settlement providing a lifetime annuity and financial security for an electrician who was seriously injured and permanently disabled when he fell through a suspended ceiling and broke his back, wrist and ankle.

We filed claims of product liability against the manufacturer of the ceiling and negligence against the owner of the facility for failing to provide a safe work place.

We are litigating a claim for a young woman who was crushed when a bag/sack weighing 2000 pounds fell on her at work rendering her a wheelchair dependent paraplegic. Suit is currently pending against the companies and corporations involved in designing, manufacturing and distributing this product without proper concern for the safety of the user.

Our firm’s courtroom experience extends to cases involving plaintiffs who have been injured through use of products, which are defective by design or defective as a result of inadequate warnings and instructions. We have prosecuted products liability cases for individuals injured by a variety of products including automobiles, trucks, tools, equipment, medical devices, drugs, and dietary supplements. Because the law in this area requires that an injured person demonstrate that the product was defective by design or defective for its failure to warn about potential dangers or risk of injury, proof of liability is complex. The cases usually require expert testimony by engineers, scientists, technicians, physicians or other specialists familiar with the product, its design, potential for injury and intended uses.

Our past and present experience includes representation of plaintiffs who have suffered catastrophic injuries, including brain injuries, cognitive impairment and severe disabilities resulting from use of defective products. The firm's work includes representation for a number of young women and men who have suffered strokes, brain damage, cognitive impairments, and physical impairments after taking natural dietary supplements containing ephedra and caffeine. Other products liability cases have involved catastrophic injuries suffered on the job in connection with use of defective materials, equipment and vehicles. The firm obtained a $1.5 million settlement with a life time tax free annuity in a product liability case for a client injured from a defective truck door lock. A number of our cases involving severe and permanent disabilities are sent to us by other attorneys who concentrate their practice in other areas and are aware of our courtroom experience with these types of claims.

Because substantial sales and profits are at stake for the manufacturers and sellers of these products, the cases are vigorously defended by the responsible companies, thereby increasing the costs necessary for successful resolution of the claims. We are willing to undertake products liability claims on a contingent fee basis with all costs advanced by us.
